All users and customers upon signing up for HostAcmee.com’s (hereafter referred to as “HostAcmee”) services, agree to comply with HostAcmee’s Terms of Services. HostAcmee may at any time modify any relevant terms, policies or notices. Customers (cumulatively referred to as “Customers” or “You” or “Your”) acknowledge that by visiting the website from time to time, you shall become bound to the following terms of services.
Age Requirement
Customers of services offered through HostAcmee must be completed at least 18 years of age. Any individual under the above said age (treated as “Minor”) must have a parent or legal guardian accept and agree to be legally bound by these terms and assume full responsibility associated with any failure of compliance with the Terms in connection with said minor’s use of any of the services.
Personal Information
You must produce accurate contact information upon signing up. Hence, it is your duty to keep profile information updated regularly.
Payment
Account setup and service renewal(s) will be done only after we have received your payment. All order(s) will be manually screened in order to avoid fraudulence and it is unto your responsibility to provide us with a valid email address which should not be an email address of domain name(s) you are signing up under. You agree to pay all applicable rates and charges for services in effect with the time of registration and/or renewal, subject to change these terms as the same may be modified by HostAcmee from time to time. It is your responsibility to ensure that all the invoices are paid on time. Billing for the recurring component of the services shall be monthly or yearly in advance. HostAcmee provides a grace period of 9 days after the due date. Further delay of payment will lead to suspension of the account by us until the same has been paid in full settlement with a late fee of $9 USD.
HostAcmee reserves the right to change or modify the fee for the services, or eliminate or modify certain services at any time. It is applicable to new registrations only.
Any invoices that paid more than once with multiple PayPal subscriptions can be credited towards the service account and cannot be refunded.
For all Dedicated server and VPS hosting services, cancellation request must be made by opening support ticket before 48hours of invoice due date.
Content
You agree to take all responsibility for all content stored and/or transmitted via your account. HostAcmee is not responsible for any files or data resides on your account.
All services provided by HostAcmee may only be used for lawful purposes. HostAcmee reserves the right to terminate any accounts that used materials, in our judgment, is illegal, threatening, or violates our Terms of Service.
Examples of unacceptable material on our shared servers
Pornography, IRC Scripts/Bots, File Dump/Mirror Scripts (similar to rapidshare), AutoSurf/PTC/PTS/PPC sites, Mail Bombers/Spam Scripts, Proxy Scripts/Anonymizers, Lottery Sites, Image Hosting Scripts, Hateful/Racist/Harassment oriented sites, Pirated Software/Warez, Hacker focused sites/archives/programs, Bruteforce Programs/Scripts/Applications, Banner-Ad services (commercial banner ad rotation), Commercial Audio Streaming (more than one or two streams), Escrow/Bank Debentures, High-Yield Interest Programs or Related Sites, Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme), MUDs/RPGs/PPBGs, Sites promoting illegal activities, Forums and/or websites that distribute or link to warez/pirated/illegal content, Bank Debentures/Bank Debenture Trading Programs, Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com), Mailer Pro.
Security
You are ultimately responsible for all activities that occur in connection with your account and registered domain name(s). This includes but not limited to compromises of username and password. HostAcmee will not be liable for any loss or damages of any kind, caused by security compromises by customers. Use of Services for creating or sending Internet viruses, worms or Trojan horses, or for pinging, flooding or mail bombing or engaging in denial of service attacks is prohibited. Hacking and related activities are prohibited. This includes, but is not limited to, unauthorized access of accounts, systems or networks, penetrating or attempting to penetrate security measures, port scans and stealth scans are prohibited.
Backup
As we are providing Backup service to customers as courtesy, it is also your duty and responsibility to backup your files and data on our servers as well as on your local computer.
Inodes
Every file such as a web page uses up 1 inode. The use of more than 50,000 inodes on any shared account may potentially result in suspension. Accounts found to be exceeding the 50,000 inode limit will automatically be removed from our backup system to avoid overusage. The use of more 250,000 inodes on hosting account will result in suspension with a prior notice. Suspension can be avoided with necessary action carried out from the customer side. Accounts that constantly create and delete large number of files on a regular basis, have hundreds of thousands of files, or cause file system to damage may be held for suspension.
Resource usage
Users may not
1. Use 20% or more system resources for longer than 90 seconds.
2. Run cron jobs with intervals of less than 15 minutes.
3. Run stand-alone unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
4. Run any software or program that interfaces with an IRC (Internet Relay Chat) network.
5. Run any type of web spider or indexer(including Google Cash / AdSpy).
6. Run any bit torrent application, tracker, or client.
7. Run any gaming servers such as counter-strike, half-life, battlefield1942, etc
8. Participate in any file-sharing/peer-to-peer activities.
Bandwidth usage
Bandwidth allocation to customers depends on their hosting plan which they are purchased on monthly basis. If the bandwidth limit reached before the end of month, then account will be suspended until the start of next month. In that case, you will be asked to switch over to next higher plan.
Unlimited Domain Hosting
HostAcmee does not hold any arbitrary limits on the numbers of domain names hosted on a hosting account. However, hosting space and data transfers for any particular hosting account are limited as per the hosting plan.
Cancellation Request
Cancellation of any services must be done in writing to billing [at] hostacmee.com at least 12days prior to expiration date of the Account and/or Services.
Service Guarantee
We offer our services 24 Hours a day, 7 days a week as long as you have paid for them. However, for one number of reasons such as equipment failures, services may be unavailable to you. Please be informed that occasional unavailability of the services can not be avoided as it is the common problem occurred in web hosting technology.
Refund Policy
We offer 30 days Money-back Guarantee on all shared hosting plans. If you are not satisfied with our service in the first 15 days after signing up, we will refund your money excluding any setup fee what we charged at the time of signing up. Moreover, you must notify us prior intimation to the first 15 days of contract. Anyway domain registration fees & SSL certificates are non refundable as you are the sole owner of any domain name/s through our service. Refunds will not be done if you did not abide our terms and conditions. Also refund is applicable for online payments only.
Spam Policy
Sending unsolicited bulk and/or commercial messages over the Internet which is treated as spam is prohibited. Any Customer who involves in spam activity will have their account terminated with or without notice. Violations of systems and network security may result in criminal and civil liability.
Disclaimer
HostAcmee shall not be responsible for and disclaims all liability for any loss, liability, damage (whether direct, indirect or consequential), expense of any nature whatsoever which may be suffered by you or any third party (including your company).
Reservation of Rights
HostAcmee reserves the right to refuse Service to anyone or cancel Service to any existing Customer.
